Baldwin, of course, was the Communist who founded the ACLU. I can think of no more devisive, ugly and wretched organization in all of American history.

Chief Justice John Marshall?! Oh pleaze, not because of the principle of judicial review in Marbury v. Madison? I mean, how "original intent" of the Constitution do we have to get? Not too long ago I heard Rush ranting about how "judicial activism" started "way back when" with Marshall. 'Scuse me, but the principal of judicial review of legislation to determine if it's constitutional has been an integral part of our legal system for two centuries. Not liking "substantive due process" (Roe v. Wade) is one thing, but don't throu out the baby with the bathwater.
